3. Subscription and Billing

The Membership is offered as a recurring monthly subscription.

Payments may be processed through: Stripe, PayPal, Apple Pay, Google Pay

By subscribing, you authorize recurring monthly charges to your selected payment method until cancellation.

All prices are displayed at checkout and may be subject to applicable taxes.

4. Automatic Renewal

Your Membership automatically renews at the end of each billing cycle unless canceled before the next renewal date.

5. Cancellation

You may cancel your Membership at any time.

Cancellation prevents future billing but does not generate a refund for the current billing period.

You will continue to have access to the Membership until the end of your current paid subscription period.

Upon cancellation or non-renewal, access to all Membership content, resources, bonuses, and community features will terminate at the conclusion of the current billing cycle.

6. Refund Policy

All Membership fees are non-refundable.

Because immediate access to digital educational content is provided upon enrollment, no refunds, credits, or partial refunds will be issued for: unused Membership time, failure to access content, lack of participation, dissatisfaction with personal progress, partial use of the Membership

7. Failed Payments

If a payment fails:

Access to the Membership may be temporarily suspended.

Additional payment attempts may be made automatically by the payment processor.

Access may be restored once the outstanding payment has been successfully completed.

SpaniCool Academy reserves the right to cancel Membership access for accounts with unresolved payment issues.

8. Account Use

Membership access is intended for one individual only.

You may not: share login credentials, allow others to access your account, transfer your Membership to another person.

Violation of this policy may result in immediate suspension or termination of access without refund.

9. Intellectual Property

All content within The SPEAK System Membership, including but not limited to lessons, videos, worksheets, exercises, downloads, templates, guides, graphics, branding, and educational materials, is the intellectual property of SpaniCool Academy.

You may not: copy, reproduce, share, resell, publish, record, redistribute, modify, create derivative works without prior written permission from SpaniCool Academy.

10. Community Guidelines

If the Membership includes access to a private community, comments section, discussion group, live sessions, or member interactions, all members must participate respectfully.

Members agree not to:

Harass, threaten, intimidate, or discriminate against others

Post offensive, abusive, or inappropriate content

Spam or promote unrelated products or services

Solicit other members

Share confidential information belonging to other members

Record, reproduce, or distribute community content without permission

Members are solely responsible for the content they post or share within the community.

SpaniCool Academy reserves the right to remove content, restrict participation, suspend access, or terminate Membership access without refund if a member violates these guidelines.

11. Educational Disclaimer

The SPEAK System Membership is provided for educational purposes only.

While the Membership is designed to help students improve their Spanish language skills, SpaniCool Academy does not guarantee: Fluency, Specific proficiency levels, Examination results, Employment outcomes, Personal or professional achievements

Results vary based on individual effort, consistency, participation, prior experience, and other personal factors.

12. No Guarantee of Results

Any testimonials, examples, success stories, or member experiences presented by SpaniCool Academy are provided for illustrative purposes only.

They do not guarantee that you will achieve the same or similar results.

Every student's learning journey is unique, and outcomes will vary.

13. Member Responsibility

You acknowledge that your progress and learning outcomes depend primarily on your own participation, effort, study habits, and implementation of the educational materials provided.

You accept full responsibility for your decisions, actions, and results arising from your participation in the Membership.

14. Chargebacks and Payment Disputes

If you experience a billing issue or have concerns regarding your Membership, you agree to contact SpaniCool Academy first at info@spanicoolacademy.com to seek resolution before initiating a chargeback or payment dispute through your bank, credit card provider, PayPal, or other payment processor.

Unauthorized or fraudulent chargebacks may result in suspension or permanent termination of Membership access.

15. Termination of Access

SpaniCool Academy reserves the right to suspend or terminate your Membership access without refund if you: Violate these Terms and Conditions, Share login credentials, Engage in abusive, fraudulent, or disruptive behavior, Violate Community Guidelines, Misuse Membership content or intellectual property

16. Technology Disclaimer

SpaniCool Academy is not responsible for interruptions, delays, or temporary unavailability of the Membership caused by: Internet service disruptions, Software failures, Third-party platform outages, Payment processor issues, Scheduled maintenance, Circumstances beyond our reasonable control

Reasonable efforts will be made to restore access as quickly as possible.

17. Limitation of Liability

To the fullest extent permitted by applicable law, SpaniCool Academy shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to the use of The SPEAK System Membership.

The Membership is provided on an "as is" and "as available" basis.

18. Privacy

Your use of the Membership is also governed by the SpaniCool Academy Privacy Policy.

By using the Membership, you consent to the collection, use, and processing of your personal information as described in that policy.

19. Changes to These Terms

SpaniCool Academy reserves the right to update or modify these Terms and Conditions at any time.

Updated versions will be posted on the website with a revised "Last Updated" date.

Continued use of the Membership after such changes constitutes acceptance of the updated Terms.

20. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Province of Quebec and the applicable federal laws of Canada.
